1. Acceptance

By accessing or using OnTheYard, you agree to these Terms of Use. If you do not agree, please do not use the service.

2. Subscription and account use

Your subscription gives access to one individual user only. Accounts are not transferable. You must not share your username, password, login link, or account access with another person or business.

We may suspend or cancel access where we reasonably believe an account is being shared, abused, used commercially outside its intended purpose, or used in a way that threatens the service.

3. Beta Access

OnTheYard is currently offered as a Beta Access service. While the core features are fully functional, you may occasionally encounter bugs, incomplete features, inaccurate search results, or temporary interruptions as we continue to improve the platform.

Your discounted Beta Access subscription reflects your early access to the service while it continues to evolve. By subscribing, you acknowledge that features, supported vehicle makes, functionality, pricing, and the user experience may change over time as improvements are released.

4. Fair use

You agree not to:

• use bots, scripts, scraping tools, crawlers, or automated systems to access the service;
• copy, harvest, bulk export, resell, or redistribute vehicle data from OnTheYard;
• attempt to bypass authentication, payment, usage limits, or technical protections;
• interfere with the performance, reliability, or security of the service;
• use the service to build or assist a competing inventory platform.

5. Vehicle and dealer information

Vehicle information is collected from publicly available dealership websites and related inventory sources. While we make reasonable efforts to keep information current and accurate, OnTheYard can only display information as cleanly and accurately as it is provided by dealers and their systems.

We do not guarantee that vehicle information is complete, accurate, current, or free from errors. Availability, pricing, specifications, location, condition, and stock status should always be confirmed directly with the selling dealer before making any purchase decision.

6. Vehicle availability

A vehicle shown on OnTheYard may already be sold, reserved, incorrectly listed, duplicated, delayed, or removed from dealer stock. Dealer feeds are not perfect. Tiny digital swamp, many crocodiles.

7. No guarantees

OnTheYard is provided on an “as available” basis. We do not guarantee uninterrupted access, complete inventory coverage, or that the service will always be error-free. Supported makes, features, pricing, subscription plans, and access levels may change over time as OnTheYard develops. Beta features may be modified, replaced, or removed without notice.

8. Monitoring and abuse prevention

We may monitor usage patterns to detect account sharing, automated access, excessive use, security issues, or activity that threatens the integrity of the service.

9. Limitation of liability

To the maximum extent permitted by Australian law, OnTheYard is not liable for loss, damage, cost, inconvenience, missed purchase opportunities, incorrect dealer information, or decisions made using information displayed on the service.

10. Changes to these terms

We may update these Terms from time to time. Continued use of OnTheYard after changes are published means you accept the updated Terms.

Privacy Policy

1. Information we collect

• your account role and access level;
• subscription status and payment-related identifiers;
• searches performed on the site;
• basic technical logs used for security, diagnostics, and service improvement.

We do not sell your personal information. We do not use your email address or personal details for unrelated purposes. We do not send marketing emails without your consent.

4. Payment information

Payments are processed by Stripe. OnTheYard does not store your full card number or payment card details.

5. Third-party services

We use trusted third-party services to operate the site, including hosting, authentication, payment processing, email delivery, and analytics. These providers may process limited data only as needed to provide their services.

6. Search analytics

We record search activity to understand which makes, models, locations, and filters are being used. This helps improve inventory coverage and product features. Search analytics are used for service improvement and business reporting.

7. Cookies and analytics

The site may use essential cookies for login and service operation. We may also use analytics tools, such as Google Analytics, to understand general site usage and improve the service.

8. Security

We take reasonable steps to protect user information. However, no online service can guarantee absolute security.
